Terms and Conditions for SpecialRequest

Welcome to SpecialRequest! By accessing or using our Service, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you may not use our Service.

1. Overview of Services

SpecialRequest is a platform where users ("Fans") can submit special song requests to participating artists ("Artists"). Artists have the right to accept, reject, or revoke any request at their sole discretion.

2. User Responsibilities

• You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service.
• You agree not to submit illegal, offensive, or inappropriate requests.
• You are responsible for any content you provide when making a request.
• You are responsible for ensuring that you have sufficient funds or a valid payment method before submitting a paid request.

3. Artist Rights

• Artists may accept, reject, or revoke any request at their discretion.
• Acceptance of a request does not guarantee delivery if unforeseen circumstances prevent fulfillment.
• Artists retain all rights to their performances and content unless explicitly agreed otherwise.

4. Payments

4.1 Payment Processing

All payments on the Service are processed by our third-party payment provider, Stripe, Inc. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. SpecialRequest does not store your full credit card or banking information.

4.2 Song Request Payments

When you submit a song request that requires payment, the total amount (including any applicable fees and taxes) will be clearly displayed before you confirm the request. By confirming, you authorize the charge to your selected payment method. The payment is captured once the Artist accepts the request.

4.3 Tips

You may have the option to send a tip to an Artist. Tips are voluntary, non-refundable, and processed immediately upon confirmation. The full tip amount (minus applicable payment processing fees) is transferred to the Artist.

4.4 Pricing and Fees

Song request prices are set by the Artist or the event organizer. SpecialRequest may charge a service fee on transactions, which will be disclosed before payment. All prices are displayed in the applicable currency and include any service fees unless otherwise stated.

4.5 Artist Payouts

Artists receive payouts through Stripe Connect. Payout timing and availability are subject to Stripe's processing schedules and the Artist's Stripe account configuration. SpecialRequest is not responsible for delays caused by Stripe or the Artist's banking institution.

5. Refund Policy

5.1 No Refunds After Acceptance

Once a song request has been paid for and accepted by the Artist, the payment is final and non-refundable. By submitting a paid request, you acknowledge and agree that no refund will be issued after the Artist has accepted the request.

5.2 Rejected Requests

If an Artist rejects your song request, the payment will be automatically cancelled and you will not be charged. If a payment was already captured, a full refund will be issued to your original payment method.

5.3 Cancelled Events

If an event is cancelled by the organizer or artist and your accepted request cannot be fulfilled, a refund may be issued at the discretion of SpecialRequest.

5.4 Tips

Tips are non-refundable under any circumstances. Please ensure you intend to tip before confirming.

5.5 Refund Processing Time

Where a refund is applicable, it will be processed within 5 to 10 business days, depending on your financial institution. Refunds are issued to the original payment method used for the transaction.

6. Intellectual Property

All content on the platform, including performances, text, and media, remains the property of the respective Artist or SpecialRequest. Users may not reproduce, distribute, or commercially exploit any Artist content without permission.

7. Prohibited Conduct

• Do not misuse the Service or impersonate others.
• Do not violate copyright, trademark, or other intellectual property rights.
• Do not harass, threaten, or abuse Artists or other users.
• Do not use stolen or unauthorized payment methods to make purchases on the Service.
• Do not attempt to manipulate, bypass, or abuse the payment or refund system.

8. Limitation of Liability

The Service is provided "as is" without warranties. We are not liable for failed, delayed, or revoked requests. To the maximum extent permitted by law, our liability is limited to the amount paid (if any) for the request in dispute. SpecialRequest is not liable for any losses or damages resulting from payment processing errors, delays, or failures by Stripe or your financial institution.

9. Termination

We may suspend or terminate your account if you violate these Terms, including but not limited to engaging in fraudulent payment activity, chargebacks, or abuse of the refund policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Quebec, Canada. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Quebec, Canada.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
